Trustmark Home Services
1. Acceptance of Terms
These Terms of Service ("Terms") form a binding agreement between you ("you," "your," or "Homeowner") and LJM LLC, doing business as Trustmark Home Services ("Trustmark Home Services," "we," "us," or "our"), governing your access to and use of the Trustmark Home Services platform, website, mobile application, and related services (collectively, the "Service").
By creating an account, accessing, or using the Service in any way, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
2. Beta Stage Notice
The Service is currently in a beta testing phase. You acknowledge and agree that:
- The Service may contain bugs, errors, or incomplete features.
- Features, pricing, and functionality may change without notice.
- The Service is provided on an "as-is" basis without warranty.
- Your feedback and usage data help us improve the Service.
3. The Service
Trustmark Home Services is a home services platform. We do three things:
(a) We connect you with licensed Contractors and facilitate payment. Contractors can send you quotes and invoices through Trustmark Home Services. You may pay a Contractor by card through our platform, or by any other method you and your Contractor agree to. If you pay by card through our platform, you may create a Trustmark Home Services account at checkout to save your card and simplify future payments.
(b) We keep a record of your home's systems and service history. If you choose to, you can build a lasting record of your home by submitting photographs of the equipment and systems inside your home. Trustmark Home Services uses proprietary analysis, including large language models and machine-assisted image processing, to identify systems visible in your photographs and organizes that information into a home record you can return to over time. Payments you make to Contractors through Trustmark Home Services also become part of this record.
(c) We help you stay ahead of home upkeep. You may authorize Recurring Service Agreements with individual Contractors — for example, monthly lawn service or quarterly HVAC maintenance — which Trustmark Home Services helps schedule, remind you about, and charge according to the terms you approved.
You may use any part of the Service independently. A Contractor may invoice you before you engage with any home-record or Recurring Service feature. You may build a home record without hiring a Contractor. Each part of the Service becomes more useful as it connects with the others, but no part is required to use any other.
3.1 The Home Record Is Not an Inspection
If you use the home-record feature described in Section 3(b), you understand and agree:
THE HOME RECORD IS NOT A HOME INSPECTION, ENGINEERING ASSESSMENT, OR PROFESSIONAL EVALUATION OF ANY KIND. Trustmark Home Services identifies what systems appear in photographs you submit; it does not assess the condition, code-compliance, safety, or functionality of any system, and it does not replace an inspection performed by a licensed professional.
You should not rely on your Trustmark Home Services home record for decisions about home purchases, sales, insurance, or any matter requiring a licensed professional opinion.
3.2 Contractor Independence
Contractors who use the Service are independent third parties. They are not employees, agents, or representatives of Trustmark Home Services. Trustmark Home Services does not perform the services that Contractors perform, does not supervise Contractors' work, and is not responsible for the quality, timing, safety, legality, or outcome of any work performed by any Contractor.
Trustmark Home Services verifies that Contractors hold a license at the time of their approval. Trustmark Home Services does not deeply vet, evaluate, or guarantee Contractors beyond this license check. Your use of any Contractor's services is at your own risk.
4. Eligibility and Account
You must be at least 18 years of age and a legal resident of the United States to use the Service. You must provide accurate, current, and complete information when creating an account and keep that information up to date.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized access.
5. Home Record and Submitted Content
Sections 5.1 and 5.2 below apply only if you use the home-record feature described in Section 3(b) and submit photographs or other content to it. If you use Trustmark Home Services only to pay a Contractor's invoice or manage a Recurring Service Agreement, and you do not submit photographs of your home, none of the licenses granted in Section 5.1 apply to you.
5.1 Home Photos and User Content
When you use the home-record feature, you may submit photographs of the interior and exterior of your home ("Home Photos"), along with information you provide about your home, your systems, and related details (collectively with Home Photos, "User Content").
You grant Trustmark Home Services a worldwide, royalty-free, sublicensable license to use, store, copy, modify, and create derivative works of your User Content solely for the following purposes:
(a) Providing and improving the Service to you, including generating and maintaining your home record and connecting you with Contractors;
(b) Sharing User Content with Contractors you engage, to the extent needed for them to provide their services to you;
(c) Training, developing, testing, and improving the proprietary analysis, including large language models and machine-assisted image processing, used in the Service, provided that any User Content used for training is either aggregated across many users or de-identified so that no individual home, address, or user is identifiable in the outputs;
(d) Generating aggregated or de-identified data for research, analysis, and improvement of the Service, and for reporting on trends in the home services industry.
This license lasts as long as we retain your User Content under our Privacy Policy. If you delete User Content or your Trustmark Home Services account, the license ends for future uses, except that we may retain aggregated and de-identified data derived from your User Content.
We will not:
Sell your identifiable User Content to third parties;
License your identifiable User Content to third parties for their own marketing or resale purposes;
Use your Home Photos in marketing materials that identify you, your address, or your home.
5.2 Your Representations
You represent and warrant that:
(a) You own or have all necessary rights in any User Content you submit;
(b) Your submission and our use of User Content under the license in Section 5.1 does not infringe any third party's rights;
(c) User Content does not contain personally identifiable information of any person other than yourself or members of your household, unless you have that person's permission to include their information;
(d) You will not knowingly submit User Content that depicts the faces, personal documents (such as identification cards, financial statements, or medical records), or other clearly identifying information of any third party.
By submitting User Content, you accept full responsibility for its contents.
6. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which describes in detail how we collect, use, store, share, retain, and sell data. By using the Service, you consent to all data practices described in the Privacy Policy.
YOU UNDERSTAND THAT TRUSTMARK HOME SERVICES COLLECTS, RETAINS, AND USES DATA YOU PROVIDE, INCLUDING AFTER YOU STOP USING THE SERVICE OR DELETE YOUR ACCOUNT, AS DESCRIBED IN THE PRIVACY POLICY.
7. Payment Terms
Certain features of the Service, including booking an in-home checkup with a Contractor, require payment. Current pricing is displayed in the Service at the time of booking.
7.1 Payment Processing
Payments are processed by Stripe, Inc. ("Stripe"). By using the Service to make a payment, you also agree to Stripe's terms of service and privacy policy. Trustmark Home Services does not store full payment card details.
7.2 Platform Fee
Trustmark Home Services retains a platform fee on each transaction processed through the Service. The remainder of each payment is remitted to the applicable Contractor via Stripe Connect, less applicable payment processing fees.
7.3 Cancellation and Refunds
You may cancel a booked checkup at any time before a Contractor has marked the job as "in progress." Cancellations made more than 24 hours before the scheduled visit window are eligible for a full refund of the platform fee paid. Cancellations made within 24 hours of the scheduled visit window may not be refunded, at Trustmark Home Services's discretion.
If a Contractor fails to arrive within the scheduled visit window without rescheduling, you may request a full refund by contacting support.
Trustmark Home Services does not refund payments for completed visits, including if the Contractor's recommendations are unsatisfactory to you. Disputes about Contractor work quality must be addressed directly with the Contractor.
7.4 Paying a Contractor Invoice
A Contractor may send you an invoice through Trustmark Home Services. You may pay the invoice by card through our platform, or by any other method you and your Contractor agree to (for example, cash, check, or a third-party payment app). When you pay by card through our platform, Trustmark Home Services facilitates the payment on the Contractor's behalf using Stripe. The full amount you pay is the amount shown on the invoice — Trustmark Home Services does not add surcharges, fees, or other charges to your card at checkout.
Contractors may send you an invoice directly, without first sending a quote, when you have already agreed to the work off-platform. The rest of this section applies whether or not the invoice was preceded by a quote.
If you dispute a charge with your card issuer, Trustmark Home Services will cooperate with your card issuer's investigation. Disputes about the quality, completion, or scope of a Contractor's work should be raised with the Contractor directly. Trustmark Home Services is not a party to the underlying service transaction between you and the Contractor.
7.5 Account Creation at Checkout and Card on File
When paying a Contractor invoice as a guest, you may choose to create a Trustmark Home Services account by checking the opt-in box on the payment page. If you check the box:
- Trustmark Home Services will create an account for you using the email address you enter at checkout, and will email you a link to set a password.
- Trustmark Home Services will securely store your payment card with Stripe so you can pay future Contractor invoices, and any Recurring Service Agreement you separately authorize, without re-entering your card details.
If you do not check the box, no account is created and no card is stored — your card details are used one time to pay that invoice and are not saved for later use.
7.6 Never Charged Without Your Approval
A payment card you have on file will never be charged without an action you take. Trustmark Home Services will only charge your saved card when you actively tap "Pay" on a specific Contractor invoice, or when a charge is required to complete a Recurring Service Agreement that you separately authorized. No Contractor, feature, cron job, admin tool, or automated process may originate a charge on your saved card without an approval you have expressly given for the specific invoice or agreement being charged.
You can view, replace, or remove your saved card at any time from the Payment method section of your Account page. Removing a saved card detaches it from your Trustmark Home Services account and prevents future charges to that card. Removing a card does not cancel any Recurring Service Agreement you have separately authorized — you must cancel those from the Recurring Services page.
7.7 Recurring Service Agreements
A Contractor may propose a Recurring Service Agreement to you — an ongoing arrangement to perform a service on a repeating schedule you approve (for example, monthly lawn service or quarterly HVAC maintenance).
How you authorize a Recurring Service Agreement. When a Contractor proposes a Recurring Service Agreement, Trustmark Home Services will show you the full terms before you accept: the Contractor's business name, the service description, the amount, the cadence (weekly, monthly, quarterly, or another interval), the payment method, and any other terms the Contractor has set. You authorize the Recurring Service Agreement by tapping the confirmation control in the interface.
When you authorize, we record the terms you approved, the date and time of your approval, and information about the device you used. This record serves as your electronic signature under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and equivalent state laws, and may be produced as evidence of your authorization in the event of any dispute.
How charges work. When a scheduled service occurrence approaches, we will notify you and give you a period to opt out before the charge is processed. If you do not opt out, we will charge the payment method you approved for the amount you approved, on or after the scheduled date. You will never be charged for a Recurring Service Agreement without your prior authorization for that specific agreement, and you will never be charged for occurrences you have opted out of.
Charge failures and card changes. If your payment method fails, we will retry the charge up to three times over one week before pausing the Recurring Service Agreement. We will notify you when a payment fails and when the agreement is paused. You may update your payment method, cancel the agreement, or contact your Contractor to resolve the issue.
Cancelling a Recurring Service Agreement. You may cancel a Recurring Service Agreement at any time from the Recurring Services page of your account. Cancellation is effective immediately for future occurrences. Any occurrence that has already been scheduled and confirmed by both you and the Contractor may still be performed and charged unless you and the Contractor agree otherwise.
Contractor unavailability. If your Contractor becomes unable to perform a Recurring Service Agreement — for example, due to illness, injury, business closure, or removal from Trustmark Home Services — we will pause future charges automatically. You will not be charged for services the Contractor cannot perform. We will notify you when the pause occurs. You may then cancel the agreement, or wait to see if the Contractor returns to service.
Refunds for recurring occurrences. If a scheduled occurrence is charged but not performed, contact us and we will work with your Contractor to resolve the issue, including refunding the charge if the service was not delivered.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF AI-GENERATED REPORTS.
TRUSTMARK HOME SERVICES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATING TO THE SERVICE.
TRUSTMARK HOME SERVICES'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO TRUSTMARK HOME SERVICES IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
TRUSTMARK HOME SERVICES IS NOT LIABLE FOR THE ACTIONS, OMISSIONS, OR WORK QUALITY OF ANY CONTRACTOR, OR FOR ANY DAMAGE, LOSS, OR INJURY ARISING FROM A CONTRACTOR'S WORK OR PRESENCE IN YOUR HOME.
9. Indemnification
You agree to indemnify, defend, and hold harmless Trustmark Home Services, LJM LLC, and our officers, directors, employees, agents, and affiliates from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) User Content you submit; (c) your violation of these Terms; or (d) your interaction with any Contractor or other user.
10. Modification of Terms
Trustmark Home Services may modify these Terms at any time by posting an updated version on the Service. Your continued use of the Service after modifications constitutes acceptance of the updated Terms. We will make reasonable efforts to notify you of material changes by email or through the Service.
11. Termination and Data
Ending your Trustmark Home Services account. You may stop using Trustmark Home Services at any time. To delete your account, contact us using the details in Section 14 or use the account deletion option in your account settings (when available). Trustmark Home Services may suspend or terminate your account at any time, with or without cause and with or without notice, including for violations of these Terms.
What we delete when you delete your account. When you delete your account, we delete your Trustmark Home Services account data — your profile, saved payment methods, and Home Photos and other User Content you submitted to the home-record feature.
What Contractors keep. Contractors you have engaged retain their own business records of their transactions with you. This includes their customer contact records (name, phone number, email address, and address as needed to perform work you engaged them for), and records of quotes, invoices, and payments between you and them. These are the Contractor's business records, kept independently in the Contractor's tools within Trustmark Home Services, and are separate from your Trustmark Home Services account.
Contractors are the data controllers for their own customer records. Your obligations and rights regarding data a Contractor holds about you — including any request for a Contractor to delete their record of you — are between you and that Contractor. Trustmark Home Services provides the tools that hold those records but does not have the authority to delete a Contractor's business records on their behalf.
Records we keep for legal and business reasons. Some records must be retained even after account deletion:
(a) Financial and tax records, including invoices, payments, refunds, and Stripe transaction records, are retained for at least seven years to comply with tax law and financial recordkeeping requirements.
(b) Aggregated or de-identified data that does not identify you personally, as described in Section 5.1.
(c) Records reasonably needed to defend against or comply with legal claims, subpoenas, regulatory investigations, or law enforcement requests.
Sections that survive. Sections relating to license grants (Section 5.1), your representations (Section 5.2), payment terms (Section 7), limitation of liability (Section 8), indemnification (Section 9), and governing law and dispute resolution (Section 12) survive termination of these Terms.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles. Trustmark Home Services is operated by LJM LLC, a Delaware limited liability company, and Delaware law provides the framework for the corporate conduct and contractual relationships underlying the Service.
Any dispute arising out of or relating to these Terms, the Service, or your use of the Service — including its interpretation, breach, termination, or enforceability — shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
You waive any objection based on inconvenient forum, and you waive any right to a jury trial in any action arising out of or relating to these Terms.
Each party is responsible for its own attorneys' fees and costs, except to the extent a court awards fees to the prevailing party as authorized by applicable law.
13. Miscellaneous
These Terms, together with the Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and Trustmark Home Services regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Trustmark Home Services's failure to enforce any right is not a waiver of that right.
